—Appellee recovered a judgment against appellant for $5125, for damages received by him through an assault committed on him by a conductor in the employ of appellant.

It appears from the statement of facts that appellee was in Waxahachie and purchased a ticket over appellant’s railroad to Eerris, where he resided. It seems that it was necessary to change cars at Garrett and take another train to Eerris, and finding that he would have to stay there for some time before the train arrived, he concluded to go to Ennis and wait there for the train.
