The dispositive question raised on appeal is whether this wrongful death action falls within an exception to section 4 of the New York Toxic Tort Reform Act of 1986, Ch. 682, § 4, reprinted in 1 McKinney’s Session Laws of New York 1567 (1986) (“revival statute” or “statute”).
