*169Defendant was convicted of murder in the second degree, and sentenced to the penitentiary for twenty years, and has appealed. In his behalf it is said that he has not had a trial before a fair and impartial jury, such as the constitution and law of the land contemplate. The specific objection is over the fact that Richard Rider, W. H. Farmer, and four others, whose names are not given, were not competent and impartial in that they stated when examined on their vow clire that they had formed and expressed opinions touching the guilt or innocence of the defendant.
