This is an action of debt, brought by the plaintiffs against the defendants, in the circuit court of the county of Jefferson, on the 27th day of March 1871. The action is based upon a bond with collateral conditions. The bond is made payable to the plaintiffs, its penalty is $400.00, and bears date the 15th day of April 1869, as alleged in the declaration. The declaration alleges that on the date last stated the defendants by their certain writing obligatory, sealed with their seals, “ bound themselves, their heirs, executors, administrators &c., jointly and severally to pay unto J. andB.…
