BRANNON, Judge:

James W. Long brought an action of debt against E. M. Campbell and others ; and upon a demurrer by the defendants to the plaintiff’s evidence judgment was rendered for the plaintiff; and the defendants sued out this writ of error.

The first point made by plaintiffs in error against the judgment is based on three alleged variances between the allegations and proofs. One of such variances is that the declaration describes a note as made to the plaintiff suing by the name of James W. Long, while the note produced in evidence is one to James Long.
