Appeal by defendant from a judgment of the Supreme Court, Queens County, rendered June 9, 1975, convicting him of robbery in the first degree, criminal possession of a weapon in the second degree and assault in the second degree, upon a jury verdict, and imposing sentence. Judgment reversed, as a matter of discretion in the interest of justice, and new trial ordered. The indictment before the court arises out of an armed robbery allegedly committed by the defendant and an accomplice of a Mr. Valerio, the complainant, in a grocery store owned by him.
