Mary Sue Merritt brought suit against Billy Jack Hutto and his daughter, alleging that Hutto “willfully, intentionally and without any justification or provocation shot and killed Raymond Merritt.” Merritt also sought to set aside as a fraudulent conveyance Hutto’s transfer of his real property to his daughter. After Hutto pleaded guilty but mentally ill to malice murder, State Farm Fire & Casualty Company brought this action seeking a declaration of no coverage under a homeowner’s insurance policy issued to Hutto.
