*762In an action to recover the outstanding balance due on a credit card, the defendant appeals from a judgment of the Supreme Court, Westchester County (Loehr, J.), entered August 6, 2009, which, upon an order of the same court entered July 17, 2009, in effect, granting that branch of the plaintiffs motion which was for summary judgment on the cause of action to recover on an account stated, is in favor of the plaintiff and against him in the total sum of $123,169.84. The notice of appeal from the order is deemed a notice of appeal from the judgment (see CPLR 5512 [a]).
