Plaintiff People for the Ethical Treatment of Animals (“PETA”) brings this action against defendant National Institutes of Health (“NIH”) under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552 (2006), and the Administrative Procedure Act (“APA”), 5 U.S.C. § 706(2) (2006).
