This action, in tort for damages, was brought by appellant against appellee; and from judgment, on verdict, for defendant, plaintiff appeals.

The plaintiff suffered personal injuries in consequence of the collapse of a grand stand, “only partially constructed,” that Drew & Davis, plaintiff’s employers, were then erecting under contract with defendant, on defendant’s premises; plans and specifications therefor being made by an architect and furnished the builders.
