This litigation arises out of a contract for deed. Ben Behmani (“Appellant”) appeals the Judgment of the trial court which found in favor of assignee Ocean Hotels, LLC (“Respondent”) on Count I of assign- or Kingfisher Hospitality, Inc.’s (“Kingfisher”) second amended petition which sought a declaratory judgment to determine: if Appellant had a claim to the real estate described in the contract for deed; if there was a balance due under the contract for deed and, if so, the amount owed; and if Respondent was entitled to reasonable attorney’s fees and costs.…
