This is a bill filed to enforce the execution of a . resulting trust, although, from the nature of the transactions between the parties, an account between them has become necessarily involved. The position assumed by the counsel for the plaintiff in error, is at once recogmzed as the law. A resulting trust does not arise from or depend upon any agreement between the parties. Its very name implies that it is independent of any contract, and is raised by the law itself upon a particular state of facts.
