Habt, C. J.,

(after stating tbe facts). It is earnestly insisted that the court erred in admitting as a part of res gestae tbe testimony of Mrs. Arthur Lang to tbe effect that she got to tbe home of Albert Lang and asked him how tbe accident occurred, and be replied that be struck a match to light a cigarette in tbe bathroom and this caused tbe explosion. Tbe record shows that Albert Lang was very severely burned. One witness testified that bis hair and eyelids, bis face, bis arms, and bis bands were burned.
