1. INTRODUCTION
This case involves the United States Navy’s obligations to protect four whale species (the “Federally Protected Whales”) under the Endangered Species Act (the “ESA”), 16 U.S.C. § 1531 et seq. Plaintiff Richard Max Strahan, proceeding pro se, seeks declaratory and injunctive relief against the defendants, Admiral Gary Roughead and Secretary Raymond E.
