Plaintiff in error, Clayton Hotchkiss, was indicted, jointly with other defendants named Lacey, Brown and Calvert, at the February term, 1931, of thfe circuit court of McLean county, for the crime of receiving stolen property. The defendants were tried together and the jury acquitted Brown and convicted the others. Hotchkiss was sentenced to the penitentiary for an indeterminate term, as provided by law, his sentence to commence upon expiration of a jail sentence imposed in another case.
