The gravamen of this complex action is the plaintiffs’ 1 allegation that they and their members have been harmed in their attempts to make aesthetic and recreational use of Virginia’s rivers, streams, and coastlines because defendant, the United States Environmental Protection Agency (EPA), has failed to perform certain dis cretionary and nondiscretionary duties imposed on it by the Clean Water Act 2 (CWA) and the Endangered Species Act 3 (ESA), in conjunction with the Administrative Procedure Act 4 (APA).
