Following a jury trial in the circuit court of Sangamon County, defendant, John A. Cline, was convicted of burglary and sentenced to a term of 1 to 3 years in the penitentiary. On appeal the appellate court affirmed the conviction, and we denied defendant’s petition for leave to appeal. (People v. Cline, 8 Ill. App. 3d 917, appeal denied, 53 Ill.2d 606.) On certiorari to the United States Supreme Court, the judgment of the appellate court was vacated and the cause remanded for further consideration in light of Wardius v. Oregon, 412 U.S. 470, 37 L.
