Scholle Corporation (“Scholle”) appeals the March 17, 1997, decision of the United States District Court for the Central District of California granting summary judgment to Blackhawk Molding Co., Inc. (“Blackhawk”). Scholle Corp. v. Blackhawk Molding Co., Inc., No. SA CV 96-0174-GLT(EEx) (C.D.Cal. Mar. 17, 1997). This ease was submitted for our decision following oral argument on December 3, 1997.
