HOLMAN, Commissioner.

In this action plaintiff sought to recover damages in the sum of $25,000 for personal injuries alleged to have been sustained as a result of defendant’s negligence. The verdict and judgment were in favor of defendant and plaintiff has appealed.

Defendant in his answer set up three defenses. The first two were a denial of plaintiff’s allegations and a plea of contributory negligence. The third was based on the alleged fact that on February 12, 1959, plaintiff executed an agreement whereby, for a valuable consideration, she released defendant from any and all claims and…
