*763In a proceeding pursuant to General Municipal Law § 50-e (5) for leave to serve a late notice of claim, the Lynbrook Union Free School District appeals from an order of the Supreme Court, Nassau County (Palmieri, J.), entered May 15, 2009, which granted the petition and deemed the notice of claim timely served nunc pro tunc.
Ordered that the order is affirmed, with costs.
