This is an eminent domain proceeding. The Okanogan-Douglas Inter-County Bridge Company, a corporation, is desirous of constructing a toll bridge across the Columbia river, running from the town of Brewster, in Okanogan county, on the north, to the opposite shore in Douglas county, and there to connect with an established and improved county road. For this purpose it brought two condemnation suits. The one in Okanogan county seeks to establish the necessity for the bridge and to condemn and appropriate the state’s tidelands.
