Petitioner brought an article 78 proceeding to annul a determination of the Adirondack Park Agency (hereinafter referred to as Agency) which disapproved petitioner’s application for approval of a three-lot subdivision on the Hudson River and the granting of shoreline variance and directing the Adirondack Park Agency to approve the plan as submitted by petitioner and to grant the variance requested.
