PHELPS, Justice.

Piarían J. Jost, hereinafter called defendant, prosecutes this appeal from a judgment rendered against him in the sum of $2,500, in favor of R. R. Ross, hereinafter called plaintiff, and Katherine D. Ross, his wife, as and for injuries claimed to have been suffered by plaintiff as the result of an alleged assault and battery made upon him by defendant.

As we view the record in this case no purpose can be served by a further statement of facts and, we shall therefore proceed to the disposition of the issues presented on appeal.
