Plaintiff, as Trustee of the Trust Estate of Raymond Kent Tongue, Jr.,1 deceased, brought suit against the defendant in the Superior Court of Baltimore City for the commuted value of a policy issued by defendant on October 2, 1957 on the life of Tongue. The case was removed to this court, where it was tried to a jury. At the close of all the evidence, defendant filed a motion for a directed verdict, on which the court reserved decision (F.R.Civ.P. 50(b), 28 U.S.C.A.), although expressing a strong tentative reaction that the motion was meritorious.
