This was an action brought by Albert Gerard and Sam Laird against James C. Davis, United States agent under the transportation act, representing the Chicago, Burlington & Quincy Bailroad Company, in the circuit court of Pike county, to recover damages alleged to have resulted from failure upon the part of the railroad company to deliver in proper time a shipment of hogs from New Salem, Illinois. A trial was had before a jury and verdict rendered in the sum of $723.50 in favor of Gerard et al., and against the railroad company, upon which judgment was rendered and this appeal followed.
