This is an original application to this court, by the commissioners of highways of the township of Edwardsville, in Madison county, for a writ of mandamus, against the board of supervisors of that county. The answer of the jury to the third interrogatory propounded on behalf of the relators is palpably erroneous, but the question there propounded is one not proper for the determination of a jury, and the error in their verdict may, for that reason, be disregarded.
The amount of the assessed valuation of the taxable property of the town of Edwardsville for the year 1885, and the estimated cost of building the two bridges, are all matters of record, and therefore provable only by the record.
