HOWARD, Judge.

This is an appeal from the Kenton Circuit Court wherein the claims of the plaintiff-appellant, Nathaniel Davis, against defendant-appellee, American States Insurance Company, were dismissed.

On July 21, 1977, this court entered an order granting plaintiff-appellant’s motion to strike the defendant-appellee’s counters-tatement and granting plaintiff-appellant’s motion to accept plaintiff-appellant’s statement of facts and issues as correct.

Plaintiff-appellant, Nathaniel Davis (hereinafter referred to as Davis), had, in 1968, purchased a two-story house located at 1332 Wheeler…
