{¶ 1} Plaintiff-appellant state of Ohio appeals from the judgment of the Jefferson County Common Pleas Court that ordered the suppression of all evidence seized without a search warrant from defendant-appellee David Desper’s pharmacies, and the suppression of all statements given by Desper’s physicians without his consent. This appeal presents two issues for review. First, whether obtaining pharmaceutical records without a search warrant violates the Fourteenth Amendment of the Constitution.
