The question presented by the record in this appeal is a question of practice. The court below author*564ized an appeal from a judgment taken against appellee before a justice of the peace, after thirty days allowed for taking such appeal had expired. The order was made pursuant to §1794 Burns 1908, §1503 R. S. 1881, which reads: “Appeals may be authorized by. the circuit court after the expiration of thirty days, when the party seeking the appeal has been prevented from taking the same by circumstances not under his control.” The affidavit filed by appellee in the circuit court in support of his…
