This suit was instituted by The City of Moundsville, a municipal corporation, to recover of “Martin Brown and W. Foss Curtis, Trustees for the Waiving Depositors of Marshall County Bank”, certain assessments for the years 1940, 1941, 1942 and 1943, to be applied to the payment of “revenue bonds” issued by the municipality for the purpose of raising funds with which to pay fifty-five per cent of the expense of constructing a “municipal public works” consisting of the pavement of thirty-seven streets, or parts of streets, on some of which four lots belonging to the defendants abut,…
