This case comes here upon an opinion of the Kansas City Court of Appeals to the effect that title to real estate is involved. The petition is one asking for the declaration of a resulting trust in realty, and in this the title to real estate is involved, provided that it asks that the title be decreed out of one person and into another. The judgment, however, is not so broad as the petition, and it is from the judgment the appeal is taken. The pleadings and facts can to a certain extent be stated together. Walter J.
