This appeal came to this conrtl on the idea that title to real estate is involved, but in looking into the record we find that that is not the case. The suit was- begun in the circuit court of Lincoln county by the plaintiff, as widow of Armstrong L. Kennedy, deceased, claiming to be entitled to dower in certain land1 alleged to have belonged to her husband! in his lifetime, and which had been sold under execution against him and the title derived by the purchaser, at the sheriff’s sale had come down to and was then held by the defendants.
