Appellant Froelich, a minor, filed this suit in the district court of Potter county, through Glenn O’Brien and Carella O’Brien, as next friends. Glenn O’Brien also sues in his own right. The petition is in form of trespass to try title for the recovery by Froelich of 480 acres of land, he further alleging in substance that his mother, Eleanor Carr, had, after the death of her first husband, married C. M. Carr; that prior to her death she was the owner of the property described; that said property had been conveyed by John T. Scott to Glenn O’Brien for a consideration of $4,300 cash and six…
