This is an action in tort in two counts for injuries sustained, (1) through negligent mainte-nance of a common hallway, (2) because of the creation and maintenance of a nuisance. The answer is general denial and contributory negligence.
The case came before the trial court on an "agreed statement of facts” which included the following pertinent evidence. Defendants at the time of the accident, March 16, 1950, and for two years previous were owners of a business block in the city of Lowell.
