This is an action of tort whereby the plaintiff seeks to recover compensation for personal injuries sustained by him in falling on a common stairway in a building-owned by the defendant. There was evidence in its aspect most favorable to the plaintiff tending to show these facts: The plaintiff with his wife, on the afternoon of December 8, 1934, dined in a restaurant on the second floor of the building owned by the defendant.
