This action was brought in the Marion Circuit Court by appellee against appellant ón a policy of insurance against fire,- and tried in the Johnson Circuit Court upon change of venue. The complaint is in one paragraph; a copy of the policy was made a part thereof. It was issued lipón a stock .of goods, wares, merchandise, and store fixtures. It contained, in addition to the usual averments in such cases, the further allegation of a written agreement entered into between the company through its adjuster and the appellee of the amount of the loss.
