OPINION AND ORDER
NORGLE, District Judge.
Before the court is Defendant Household Bank’s Motion for Partial Summary Judgment (Doc. No. 25-1). For the following reasons, the motion is granted in part, and denied in part.
I. BACKGROUND
In September 1995, Plaintiff Elizabeth Greisz (“Greisz”) contacted Defendant Golden Seal Heating & Air Conditioning, Inc. (“Golden Seal”) about purchasing a Carrier brand gas furnace and air conditioner (the “Carrier Equipment”) for the rental property she owned.
