CROW, District Judge.

On July 28, 1993, the State of Kansas, ex rel., Secretary of Social and Rehabilitation, filed a complaint in this case against Donna Shalala, Secretary of the United States Department of Health and Human Services. The complaint seeks $6,123,973 owed for five fiscal quarters beginning April 1, 1988, and ending June 30,1989, under the Aid to Families with Dependent Children-Foster Care and Adoption Assistance program (AFDC-FC), “as required by the Social Security Act, 4 [42] U.S.C. §§ 603 and 674, and implementing federal regulations, 46 C.F.R. §§ 201.5…
