On January 19, 1971, Veeck instituted this diversity action in the U. S. District Court for the District of Arizona.

The plaintiff alleged that on October 19, 1969, an Arizona newspaper published a want-ad which had been placed by the defendants’ agent. The ad purported to seek a person to operate the defendants’ soon-to-be-established commodities brokerage office.
