MEMORANDUM OPINION AND ORDER

HADEN, Chief Judge.

On September 5, 1990, Plaintiff Rodney D. Roush (Mr. Roush) filed his complaint against the Defendants alleging that they improperly suggested his wages pursuant to W.Va.Code, § 48A-1-1, et seq. (West Virginia Enforcement of Family Obligations Act). The named Defendants include Judith Annette Roush (Mrs. Roush), Mr. Roush’s ex-wife; the West Virginia Department of Human Services (DHS); Betty Wickline (Wickline), a paralegal with DHS; and Rhone-Poulenc Ag Company (RP), Mr. Roush’s employer.
