O’NIELL, Chief Justice.

The judges of the Court of Appeal for the First Circuit, availing themselves , of the provisions of section 25 of article 7 •of the Constitution (1921), have asked for instruction on a question of law. The question is whether, in a tort action, which is subject to the prescription of one year, the filing of the suit and serving of the citation on the next day after the year has expired will interrupt prescription, when the last day of the year was Sunday.
