This is an appeal by the defendant from the judgment of the district court for Lancaster county. Tbe plaintiff brought an action to recover damages for persona] injuries alleged to have been caused by the careless, negligent and unlawful manner in which the appellant, on the 1.9th day of July, 1908, ran, handled, and managed an automobile, so that, as alleged in the petition, it struck and overturned the carriage in which the plaintiff was then riding with her husband, son and daughter, and threw the plaintiff, with violence, out of said carriage *223upon a paved street in tlie city of Lincoln,…
