{ 1 In May 1999, Petitioner Taberone Dave Honie was convicted of aggravated murder. Mr. Honie waived his right to a jury at sentencing and was subsequently sentenced to death by the trial judge. Following an unsuccessful direct appeal, Mr. Honie sought postconviction relief pursuant to the Utah Post Conviction Remedies Act (PCRA). This case comes before the court on appeal from a grant of summary judgment denying Mr. Honie postconviction relief on the basis of ineffective assistance of counsel.
