After this action was at issue and upon the court calendar for trial at a regular term of court, plaintiff, through his. attorneys, entered into the following written stipulation with defendant: “It is hereby stipulated by and between the parties to the: above-entitled action that the said action be and the same is hereby dismissed with prejudice and without cost to either party.” This stipulation was filed in the office of the clerk of the district court of Richland county, where the case was at issue.
