This matter arose out of a personal injury action brought by appellees, Ruby B. Cassi-dy and Robert B. Cassidy, as parents and next friends of Robert DeShawn Cassidy (DeShawn), a minor, against the District of Columbia when DeShawn, a kindergarten student, was struck in the left eye by a stick thrown by another student on December 2, 1977. This accident resulted in the loss of DeShawn’s eye.
