This is an action brought by the respondent, Daniel O’Leary, against the appellants, James Duvall and James H. Woolery. The complaint alleges, substantially, that on the 28th day of January, 1893, the respondent purchased of James O’Leary the real estate mentioned in the complaint, together with other property, and paid him for the same ; that the deed was duly executed to him for said property and recorded on February 3, 1893 ; that on the 27th day of January, 1893, the appellant Duvall obtained a verdict' against James O’Leary in the…
