This was a suit at law brought to charge a trust estate in the hands of the defendant, as trustee, with the value of goods furnished by the plaintiffs, alleged to be necessary for the cultivation of the land belonging to the trust estate, and for the maintenance and support of the oestuis quo *127trust. The declaration stated that the defendant’s wife (naming her) and her children were the cestuis que trust, and also described the property of which the estate consisted, but it did not set forth the terms of the trust, so as to disclose to the court and jury what were its scope and…
