In May, 1898, Greene brought suit against the Central of Georgia Railway Company for damages alleged to have been sustained on account of the killing, by a freight-train of the defendant, of a mule belonging to the plaintiff. Among the grounds of negligence set forth in the petition was an allegation that the defendant was negligent in operating its train on Sunday, in violation of *860the provisions of section 420 of the Penal Code.
