The plaintiff in error sued the defendant in error to recover the sum of $700 paid to him by one Burnett, the former guardian of Grace L BerryhTl, and in the petition filed in said action it is alleged that one Ledbetter is the duly authorized guardian of said Grade I. Berry-hill, and that some time prior to the appointment and qualification, one Bates B.
