— This appeal is prosecuted from a judgment awarding mandamus in favor of the respondent, requiring appellants, as commissioners of Skagit county, to proceed to make an assessment by the apportionment of the cost of the construction of a drainage system, known as the “Olympia Marsh Ditch,” against various tracts of land claimed to be benefited by such improvement, excluding therefrom certain school lands.
